Impasse in Appointment of the Attorney General Violates the Rule of Law

The Malaysian Bar is alarmed and deeply troubled at the reported impasse in the appointment of a new Attorney General. 

Over three weeks have lapsed since the Prime Minister, Tun Dr Mahathir Mohamad, announced that the current Attorney General, Tan Sri Dato' Sri Haji Mohamed Apandi Ali ("Tan Sri Apandi Ali"), is on garden leave.  Since then the Solicitor General has been temporarily performing the functions of the Attorney General.  It would thus seem that the intention was to remove Tan Sri Apandi Ali and to appoint a new Attorney General, but a stalemate has arisen. 

The Attorney General has a vital role to play as the principal legal adviser to the Government and the Public Prosecutor, and it is therefore imperative that a new Attorney General be appointed without further delay.

Article 145(1) of the Federal Constitution states: "The Yang di-Pertuan Agong shall, on the advice of the Prime Minister, appoint a person who is qualified to be a judge of the Federal Court to be the Attorney General for the Federation" [emphasis added].  As a constitutional monarch, the Yang di-Pertuan Agong has a constitutional duty to abide by the Federal Constitution, which clearly stipulates that His Majesty must act on the advice of the Prime Minister. The Yang di-Pertuan Agong must therefore appoint the person, as per the advice of the Prime Minister, as the new Attorney General, and end the impasse without delay.

The exercise of the constitutional duties by the Yang di-Pertuan Agong in the appointment of the new Attorney General should not be stifled by extraneous views that take into consideration any criteria that are without constitutional basis, based on irrelevant considerations, or which could be deemed to be arbitrary or discriminatory.  The Yang di-Pertuan Agong must perform the role of a constitutional monarch strictly in accordance with the provisions of the Federal Constitution. 

The Malaysian Bar reiterates that the new Attorney General, as the principal legal adviser to the Government, should be an experienced career lawyer with all-round legal skills and expertise in public law, and be widely regarded and accepted as independent and able to implement law reforms of the Government effectively and impartially.  It must also be a prerequisite that the new Attorney General possess an unimpeachable reputation and character, integrity, honesty, and sound legal knowledge and learning.

Such an appointment would augur well for the many institutional reforms that the Government is introducing to birth a new beginning for our nation.

Update on E-Courts | E-Filing and Digital Certificate and Token
We refer to Circular No 104/2017 dated 25 May 2017, and Circular No 135/2017 dated 5 July 2017, where we informed Members of the Bar that the e-Court Phase 2 system is replacing the e-Court Phase 1 system, and provided updates to assist Members with the transition.
(1) Application Process for Digital Certificate and Token
The Bar Council has received numerous complaints regarding the delay in the process of purchasing and obtaining digital certificates and tokens from the vendor, Augmented Technology Sdn Bhd.
We have been liaising with Augmented Technology Sdn Bhd to simplify and expedite the application process.  You are now required to provide only the following, to apply for your digital certificate and token:
(a) A completed Personal Certificate Application Form, available for download from here;
(b) A photocopy of your National Registration Identification Card ("MyKad"); and
(c) Payment and payment slip (online banking / CDM).
For additional details, please refer to the Personal Certificate Application Form.
This new, simplified procedure will take effect on 6 Oct 2017 (Friday).

Rate of Goods and Services Tax to Become Zero Per Cent
As you may be aware, the Prime Minister of Malaysia, Tun Dr Mahathir Mohamad, issued P.U. (A) 118/2018 entitled "Goods and Services Tax (Rate of Tax) (Amendment) Order 2018" dated 16 May 2018, which specifies that the rate of the Goods and Services Tax ("GST") will be amended from 6% to 0% with effect from 1 June 2018.  A copy of P.U. (A) 118/2018 is attached for your reference.
Also attached are copies of the following orders, also dated 16 May 2018, from the Federal Government Gazette:
(1) P.U. (A) 119/2018: Goods and Services Tax (Zero-Rated Supply) (Revocation) Order 2018;
(2) P.U. (A) 120/2018: Goods and Services Tax (Relief) (Revocation) Order 2018;
(3) P.U. (A) 121/2018: Goods and Services Tax (Imposition of Tax for Supplies in Respect of Free Zones) (Revocation) Order 2018;
(4) P.U. (A) 122/2018: Goods and Services Tax (Application to Government) (Revocation) Order 2018; and
(5) P.U. (A) 123/2018: Goods and Services Tax (Imposition of Tax for Supplies in Respect of Designated Areas) (Revocation) Order 2018.
Members are advised to take note of the statutory rules in respect of "time of supply", as GST may, in certain instances, still need to be included in tax invoices issued after 1 June 2018.  For example, all billings after 1 June 2018 that include or relate to any taxable supplies made prior to 1 June 2018 will still attract GST and thus require tax invoices.
Please consult your tax adviser if you have any queries regarding the foregoing and/or the transitional period.
Please refer to the website of the Royal Malaysian Customs Department ("RMCD") at http://www.customs.gov.my/ms for the latest guidelines and updates, including its "Frequently Asked Questions (FAQ) Transitional 6% – 0%" ("FAQ"). Members should bear in mind that RMCD may issue guidelines or updates that may modify or contradict those previously issued.

Arahan Amalan Ketua Hakim Negara Bil 1 Tahun 2018
Panduan Pemfailan dan Pembayaran Fi Alokatur

The Chief Registar of the Federal Court of Malaysia, Dato' Sri Latifah binti Haji Mohd Tahar has extended to us a copy of Arahan Amalan Ketua Hakim Negara Bil. 1 Tahun 2018 ("Arahan Amalan 1/2018") dated 25 Apr 2018, pertaining to filing guidelines and payment of allocatur fees.

Please be informed that Arahan Amalan 1/2018 came into operation with immediate effect.

Arahan Amalan Ketua Hakim Negara Bil 1 Tahun 2016 entitled "Panduan Pemfailan dan Pembayaran Fi Alokatur" (undated), contained in Bar Council Circular No 259/2016 dated 17 Nov 2016, is thereby revoked.

The relevant portion of Arahan Amalan 1/2018 is reproduced below, and a copy of it is attached for your reference.

PANDUAN PEMFAILAN DAN PEMBAYARAN FI ALOKATUR
Setelah berunding dengan YAA Presiden Mahkamah Rayuan, YAA Hakim Besar Malaya dan YAA Hakim Besar Sabah dan Sarawak, dan selaras dengan Aturan 85 Kaedah-­Kaedah Mahkamah Persekutuan 1995 [P.U (A) 376/95], Aturan 55 Kaedah-Kaedah Mahkamah Rayuan 1994 [P.U.(A) 524/94] dan Aturan 59 kaedah 7(4) Kaedah-Kaedah Mahkamah 2012 [P.U.(A) 205/2012], saya mengeluarkan Arahan Amalan ini bagi Panduan Pemfailan dan Pembayaran Fi Alokatur.


PEMAKAIAN ARAHAN AMALAN

2.    Arahan Amalan ini terpakai kepada penghakiman di Mahkamah Persekutuan, Mahkamah Rayuan dan Mahkamah Tinggi sahaja.


Fl ALOKATUR

3.    Apabila Mahkamah memberikan award atau suatu perintah terhadap kos, award atau perintah tersebut adalah tertakluk kepada pembayaran fi alokatur.

4.    Walau bagaimanapun, kos yang diawardkan kepada atau terhadap Kerajaan Persekutuan dan Kerajaan Negeri TIDAK TERTAKLUK kepada fi alokatur.

5.    Sekiranya kos diberikan kepada lebih daripada satu pihak dalam satu kes, fi alokatur hendaklah dibayar sama rata oleh pihak-pihak yang menerima kos melainkan diperintahkan sebaliknya oleh Mahkamah.


TATACARA PEMFAILAN DAN PEMBAYARAN Fl ALOKATUR

6.    Setelah sesuatu tindakan atau permohonan atau rayuan dibenarkan atau ditolak dengan kos, draf perakuan alokatur hendaklah difailkan bersekali dengan draf perintah Mahkamah.

7.    Draf perakuan alokatur HENDAKLAH mengikut format sebagaimana ditetapkan dalam LAMPIRAN A.

8.    (1)     Salinan bersih Perintah Mahkamah dan perakuan alokatur hendaklah difailkan setelah draf perintah dan draf perakuan alokatur diluluskan oleh Mahkamah.

       (2)    Pembayaran fi alokatur hendaklah dijelaskan sepenuhnya oleh pihak yang memfailkan perintah dan perakuan alokatur semasa pemfailan tersebut.

9.    Perintah Mahkamah bermeterai TIDAK akan dikeluarkan MELAINKAN SETELAH fi alokatur dijelaskan sepenuhnya.

10.    Fi alokatur yang dibayar boleh dituntut daripada pihak yang diperintahkan membayar kos.


TARIKH PERMULAAN KUAT KUASA

11.    Arahan Amalan ini mula berkuat kuasa pada tarikh Arahan Amalan ini dikeluarkan.


PEMBATALAN ARAHAN AMALAN KETUA HAKIM NEGARA BIL.1 TAHUN 2016
12.    Arahan Amalan Ketua Hakim Negara Bil. 1 Tahun 2016 adalah dibatalkan.

As Salam. Tuan/Puan, sistem e-filing ada masalah akses oleh peguam. Agensi ok sebab guna 1govnet. Jadi arahan Puan DCR utk buat pengumuman supaya peguam buat pemfailan di servis biro. Bayaran servis biro dikecualikan utk sementara ini.

Sila maklumkan kepada State BAR masing2 utk peguam bawa softcopy documents utk filing kerana scanner adalah terhad.

Jika peguam tidak keberatan utk buat e-payment menggunakan komputer mahkamah atau laptop sendiri (bawa token internet banking dan authorised access password), peguam tak perlu beratur di servis biro, boleh guna laptop sendiri guna network mahkamah. Site admin tolong uruskan utk bagi peguam guna  internet cable jika dia bawa laptop sendiri.
