Request for Information to Establish a Resource Centre to Assist Small Law Firms
The Bar Council Small Firms Committee is in the process of initiating the establishment of a resource centre that will assist small law firms by offering information on providers of services that are essential to legal practice.
We invite Members of the Bar to provide us with contact details for the following service providers, if you are familiar with capable and reliable providers:

(1) Binding service for law reports;
(2) Dispatch services and process servers;
(3) Foreign jurisdiction process servers; (4) Handwriting experts;
(5) Interpreters;
(6) Legal Researchers;
(7) Part-time account executives;
(8) Part-time clerks;
(9) Private investigators;
(10) Property and shares valuers;
(11) Prosthetic and nursing care providers; and
(12) Transcribers.

In addition, we seek feedback from Members regarding your experience as well as any pertinent information concerning the service providers you have previously engaged.

Implementation of Goods and Services Tax ("GST") for Foreclosure Proceedings and Public Auctions for Immovable Properties at the High Court of Malaya
The Registrar of the High Court of Malaya has extended to us a copy of a letter entitled "Pelaksanaan Cukai Barang dan Perkhidmatan (GST) di dalam Prosiding Halang Tebus dan Lelongan Awam Harta Tak Alih di Mahkamah Tinggi Malaya".
The implementation of GST for foreclosure proceedings and public auctions for immovable properties at the High Court of Malaya took effect from 1 Apr 2015.
The relevant portion of the letter is reproduced below, and a copy of it is attached for your reference.

PELAKSANAAN CUKAI BARANG DAN PERKHIDMATAN (GST) DI DALAM PROSIDING HALANG TEBUS DAN LELONGAN AWAM HARTA TAK ALIH DI MAHKAMAH TINGGI MALAYA
Dengan segala hormatnya saya merujuk kepada perkara di atas.
2.         Adalah dimaklumkan bahawa satu mesyuarat penyeragaman proses kerja prosiding halang tebus dan lelongan awam bagi harta tak alih di Mahkamah Tinggi Malaya telah di adakan antara Pejabat Mahkamah Tinggi Malaya, Jabatan Kastam Diraja Malaysia, Majlis Peguam Malaysia dan Majlis Pelelong Malaysia pada 30 Mac 2015.  Ketetapan-ketetapan berikut telah dicapai:-
 2.1       Tarikh Kuatkuasa

Pelaksanaan Cukai Barang dan Perkhidmatan (GST) di dalam prosiding halang tebus dan lelongan awam harta tak alih di Mahkamah Tinggi Malaya akan mula berkuatkuasa mulai 1 April 2015.
          2.2       Cukai Barang dan Perkhidmatan
Selaras dengan penguatkuasaan Akta Cukai Barang dan Perkhidmatan 2014 (Akta 762), adalah dimaklumkan bahawa bagi tujuan prosiding halang tebus dan lelongan awam harta tak alih perkara-perkara berikut hendaklah diambil maklum:-
a)    Pelaksanaan Cukai Barang dan Perkhidmatan tersebut hanya melibatkan Hartanah yang digunakan untuk tujuan komersil, pentadbiran dan perindustrian seperti rumah kedai, pejabat, perniagaan runcit, pejabat kecil pejabat rumah (SoHo), pejabat kecil pejabat maya (SoVo), pejabat kecil pejabat fleksibel (SoFo), kilang, hotel, motel, rumah penginapan, asrama dan gudang.
b)    Pelaksanaan Cukai Barang dan Perkhidmatan tersebut tidak melibatkan Hartanah yang digunakan untuk tujuan pertanian, perumahan (termasuk rumah kediaman seperti rumah teres, rumah berkembar, rumah sesebuah, pangsapuri termasuk pangsapuri perkhidmatan dan kondominium) atau kegunaan umum seperti perkuburan, taman permainan dan keagamaan.
c)    Harga jualan bagi hartanah yang berjaya dilelong adalah termasuk dan tertakluk kepada Cukai Barang dan Perkhidmatan yang berjumlah 6 peratus dari harga jualan dan hendaklah dibayar oleh pihak Plaintif kepada pihak Jabatan Kastam Diraja Malaysia.
          2.3       Arahan Amalan Berkaitan Perlaksanaan GST
Satu arahan amalan berkaitan perkara di atas akan dikeluarkan oleh Pejabat ini dalam sedikit masa lagi setelah kajian atas kesemua maklum balas oleh pihak-pihak berkaitan di sempurnakan.

Please note that it is not compulsory for item (6) and item (7) to be paid together with items (1) to (5).  Payment of item (6) and item (7) can be made upon application for your 2016 Sijil Annual / Practising Certificate. 
We would like to draw your attention to sections 44, 46(5) and 46(6) of the Legal Profession Act 1976, which read as follows (emphases added):
Section 44 All members who are not in arrears with their subscription under section 46 shall be eligible—
(a) to attend and vote at any general meeting;
(b) subject to section 46A, to be elected to the Bar Council; and
(c) to vote on the election of members to the Bar Council.
Section 46(5) Liability to pay any annual subscription to the Malaysian Bar shall arise when the subscription has been fixed by the Bar Council. All annual subscriptions to the Malaysian Bar shall be paid by the 30th day of June of each year.
Section 46(6) An advocate and solicitor shall, if he pays his annual subscription after the date mentioned in subsection (5), pay to the Bar Council, in addition to the subscription due, an amount equivalent to the subscription so due.
Please note that the deadline of 30 June 2015 for payment of the annual subscription must be strictly adhered to and no application for waiver of penalty will be entertained.  If you fail to pay by the deadline of 30 June 2015, you will have to pay an additional sum of RM450.
Kindly ensure that your name and membership number are clearly written on the reverse side of each cheque.  The receipt for the sum of RM920 will be indicated as "Bar Council Subscription". 
The payment guide, which includes samples of how the cheques should be drawn for the relevant payments, is attached for your attention (refer to Appendix 1).
Also attached is a set of "Frequently-Asked-Questions on Bar Council Subscription" (refer to Appendix 2).
As part of Bar Council's initiative to improve and upgrade our services to Members of the Bar, the e-Statement feature was introduced on the Malaysian Bar website on 28 Sept 2011.  Registered users of the Malaysian Bar website can view, and download, the details of their own subscription payment records, and print receipts of payments made for the Bar Council subscription.  For more details, please refer to Circular No 297/2011 dated 19 Dec 2011.

Come join the Bar Council Constitutional Law Committee! (29 May 2015)
Be a member of the Bar Council Constitutional Law Committee, which runs the MyConstitution Campaign.  It is essentially a campaign by the rakyat and for the rakyat; a campaign to bring the Federal Constitution into the hearts and minds of the people.  And for this very reason, you are all invited to be campaigners for the MyConstitution Campaign.
The MyConstitution Campaign was launched in 2009 in response to the growing interest and political awareness of Malaysians on constitutionalism and the rule of law in the country.  Beginning with the production of nine booklets that simplify the Federal Constitution (the Rakyat Guides), nine short videos on themes within the Federal Constitution (the Rakyat Service Advertisements) and nine launch events nationwide, we have held various forums, workshops, lectures, and a music concert (Rock for Rights), as well as produced articles and participated in both television and radio programmes, on the Federal Constitution.
However, in spite of all these activities, the level of awareness about the Federal Constitution, and what it means to have one, is still low among many Malaysians.  Therefore, more needs to be done, and we need more help to bring the MyConstitution Campaign to the next level!  Anyone may join the committee and spearhead its projects.  We need new energy and fresh ideas to help further spread awareness about constitutionalism to all segments of society.
The details of our first committee meeting for the 2015/2016 term are as follows:

Time:       6:30 pm to 8:30 pm
Venue:     Meeting Room 1, 3rd Floor, Bar Council, 15 Leboh Pasar Besar, 50050 Kuala Lumpur
