Request for Feedback on Issues Relating to Conveyancing Practice

To Members of the Malaysian Bar
Request for Feedback on Issues Relating to Conveyancing Practice
The Bar Council Conveyancing Practice Committee ("CPC") plans to organise meetings with the following authorities and organisations to discuss issues faced by Members of the Bar:
(1) Tax Operation Department, Inland Revenue Board of Malaysia (Lembaga Hasil Dalam Negeri Malaysia, "LHDNM");
(2) Wilayah Persekutuan Kuala Lumpur Land and Mines Office (Pejabat Tanah dan Galian Wilayah Persekutuan Kuala Lumpur);
(3) Selangor Land and Mines Office (Pejabat Tanah dan Galian Selangor);
(4) Association of Banks in Malaysia;
(5) Association of Islamic Banking Institutions Malaysia;
(6) Association of Development Finance Institutions of Malaysia;
(7) Bank Negara Malaysia;
(8) Real Estate and Housing Developers' Association Malaysia;
(9) Malaysian Institute of Estate Agents; and
(10) National House Buyers Association.
To have meaningful and effective meetings, we invite Members to provide feedback on issues relating to conveyancing practice, including details of the following:
(1) Specific branches of LHDNM;
(2) Specific branches of Land and Mines Offices;
(3) Specific branches of financial institutions or banks;
(4) Developers; and
(5) Estate agents.
CPC will collate the responses in preparation for the meetings.

(3) post to Conveyancing Practice Committee (Attention: Chuah Ying Ying), Bar Council Malaysia, 15 Leboh Pasar Besar, 50050 Kuala Lumpur.

E-Payment for Third Party Bodily Injury and Property Damage Claims

To Members of the Malaysian Bar
E-Payment for Third Party Bodily Injury and Property Damage Claims
Bank Negara Malaysia ("BNM") has informed Persatuan Insurans Am Malaysia ("PIAM") to actively promote, and also utilise e-payment systems and move away from the practice of issuing cheques.  The initial deadline to migrate to e-payment systems by 1 Apr 2014 has been extended to 31 Dec 2014.
PIAM had written to Bar Council to propose that payments involving third party bodily injury and third party property damage claims without court orders, should be made via e-payment directly into the claimant's account.
Bar Council replied to PIAM proposing that Members would only agree to e-payments being made to the solicitor's client accounts, with the consent of the claimants.
PIAM rejected Bar Council's proposal, and subsequently proposed the following:
(1) Payments be made to claimant's own / personal account; or
(2) Payments be made to the public trustee who would administer the payments to the claimants and their solicitors.
Bar Council rejected both proposals, and has requested a meeting with PIAM in order to resolve these issues.
