Malaysia-Talk on 'Competition Law in Malaysia' - 11 June 2014

Talk on 'Competition Law in Malaysia' - 11 June 2014

THE MALAYSIAN INSTITUTE OF ARBITRATORS

A Talk on
"Competition Law in Malaysia"
By

Sudharsanan Thillainathan
Wednesday, 11 June 2014

Brief Synopsis
The Competition Act 2010 ("the Act") came into effect on 1 January 2012 and is regulated by the Malaysian Competition Commission ("MyCC"). This law provides a regulatory framework against market manipulation, cartel and monopolistic practices. The rationale for the Act is to promote healthy competition in order to achieve an efficient and dynamic economy.

The Act is extremely relevant to any entity that carries on a "commercial activity" and as such the MyCC's radar is on all businesses, big and small in Malaysia. The MyCC has already made its first decision against the Cameron Highlands Flower Association, finding them guilty of Price Fixing, and has provisional decisions against ice manufacturers, the airline industry etc. The talk provides an overview of the Act and the current state of competition law 2 years on.
.
Outline:
·         Key provisions relating to the rules against anti-competitive agreements and abuse of dominance.
·         Latest amendments to the Act.
·         Summary of MYCC's decisions and/or provisional decisions to date.

Sudharsanan Thillainathan
