Agenda and Motions for the 68th Annual General Meeting of the Malaysian Bar
Please be reminded that the 68th Annual General Meeting ("AGM") of the Malaysian Bar will be held as follows:
Date:               15 Mar 2014 (Saturday)
Time:              10:00 am
Venue:            Grand Ballroom, Level 1, Convention Centre, Renaissance Kuala Lumpur Hotel, Corner of Jalan Sultan Ismail and Jalan Ampang, 50450 Kuala Lumpur

The agenda for the AGM is as follows:
(1) To consider and, if approved, to adopt the minutes of the 67th AGM held on 16 Mar 2013;
(2) To discuss matters arising from the 67th AGM (please refer to the AGM Update Sheet on pages 64 to 67 of the 2013/2014 Annual Report);
(3) To consider the President's Report and committees' reports re: Activities of the Malaysian Bar for the year 2013/2014;
(4) To consider and, if approved, to adopt the Audited Accounts of the Malaysian Bar for the year ended 31 Dec 2013;
(5) To consider the following motions proposed in accordance with section 64(6) of the Legal Profession Act 1976:
(5.1) "Motion regarding the Continuing Professional Development ("CPD") Scheme", jointly proposed by Dipendra Harshad Rai and Raphael Tay (Co-Chairpersons, Bar Council Professional Standards and Development Committee), on behalf of the Bar Council, dated 7 Mar 2014 (pages 3 to 5 of the attached bundle of motions);
(5.2) "Motion on the amendments to the Prevention of Crime Act 1959", proposed by Christopher Leong (Chairman, Bar Council), on behalf of the Bar Council, dated 7 Mar 2014 (pages 6 to 11 of the attached bundle of motions);
(5.3) "Motion on environment and climate change: Government to ensure effective enforcement of environmental laws and to uphold its pledges to the international community to reduce Malaysia's carbon emissions by 40% by the year 2020", jointly proposed by Roger Chan Weng Keng and Chew Swee Yoke (Co-Chairpersons, Bar Council Environment and Climate Change Committee) and seconded by Hon Kai Ping (Deputy Chairperson, Bar Council Environment and Climate Change Committee), on behalf of the Bar Council, dated 7 Mar 2014 (pages 12 to 15 of the attached bundle of motions);
(5.4) "Motion regarding retired judges of the superior courts appearing as counsel in court", jointly proposed by V C George and Razlan Hadri Zulkifli, dated 5 Mar 2014 (pages 16 to 18 of the attached bundle of motions);
(5.5) "Motion on domestic inquiry, misconduct, and respect of worker and trade union rights in Malaysia", proposed by Charles Hector Fernandez, dated 6 Mar 2014 (pages 19 to 22 of the attached bundle of motions);
(5.6) "Motion in the matter of fair and equal competition in conveyancing loan for sole proprietorship firms and partnership firms", proposed by Raymond Chu Hon Fai and seconded by Devinia Loganathan, dated 7 Mar 2014 (pages 23 to 27 of the attached bundle of motions);
(5.7) Motion to "amend/delete S49 and S51 of the Legal Profession Act 1976", proposed by Naran Singh and seconded by Ashvinder Kaur, dated 7 Mar 2014 (pages 28 to 29 of the attached bundle of motions); and
(5.8) Motion regarding the death penalty, proposed by Naran Singh and seconded by Ashvinder Kaur, dated 7 Mar 2014 (page 29 of the attached bundle of motions); and
(6) General.
In accordance with section 64(4) of the Legal Profession Act 1976, the quorum for the AGM shall be 500 Members of the Malaysian Bar.  Members are urged to make every effort to attend the AGM so that issues affecting the profession may be effectively discussed by as many Members as possible.
Attached is a document containing the eight abovementioned motions that have been proposed for consideration at the AGM.  If you are a registered user of the Malaysian Bar website, you may also click here to view the eight motions, and here to download the 2013/2014 Annual Report.
Members who attend the AGM will receive a print copy of the 2013/2014 Annual Report on a first-come, first-served basis.  Please note that only limited print copies of the 2013/2014 Annual Report have been produced.

Note
(1) Members are kindly requested to make every effort to attend the meeting punctually to ensure a quorum of 500.  If the quorum is not present by 11:00 am, the AGM shall be adjourned to 11:15 am on the same day and at the same venue.
(2) Registration counters will open from 8:30 am.  Light refreshments will be served.
(3) All Members and pupils in chambers will be required to produce their National Registration Identity Card ("NRIC") or driver's licence in order to register their attendance for the AGM.
(4) All Members and pupils in chambers shall, upon registering their names, wear the designated wristbands for the purpose of admission.
(5) Pupils in chambers may attend but shall not vote, and shall be seated only at the area(s) designated for them.
(6) Under the Continuing Professional Development ("CPD") Scheme, Members and pupils in chambers will earn one CPD point for attending the AGM.
(7) For information on preferential hotel corporate rates secured by Bar Council, please refer to the current list, which can be downloaded from the scroll box located on the top right-hand section of the Malaysian Bar website, at www.malaysianbar.org.my

(Disclosure Requirements for Trust Accounts and Joint Accounts) Regulations 2012
We refer to Circular No 024/2013 dated 23 Jan 2013, whereby we informed Members of the Malaysia Deposit Insurance Corporation (Disclosure Requirements for Trust Accounts and Joint Accounts) Regulations 2012 ("Regulations 2012"), which came into operation on 27 Nov 2012.
We have been requested by Malaysia Deposit Insurance Corporation (also known as Perbadanan Insurans Deposit Malaysia, "PIDM")  to remind Members to comply strictly with the Regulations 2012 and to submit the trust account information to banks or financial institutions by 31 Mar 2014 (Monday).
The relevant portion of the notice we received from PIDM is reproduced below.

Attached is a copy of PIDM's "Frequently Asked Questions Relating to Insurance Cover" ("FAQs"), which provides information regarding PIDM's deposit insurance coverage and PIDM's requirements in relation to trust account.

Reminder to update trust account information by 31 March 2014
Under the Regulations, if your members hold deposits in trust for two or more beneficiaries in a single trust account at our member bank, they are required to submit certain trust account information to our member bank, on an annual basis. However, trustees who hold deposits in trust for only a single beneficiary are not required to submit.
The submission should include updated information relating to the trust account, the beneficiaries, and the percentage interest to which the beneficiaries are entitled to. Your members are given the flexibility to submit the required beneficiary information by way of a separate alphanumeric code or other identifier to preserve the beneficiaries' confidentiality. The deadline for the 2014 submission, based on 31 December 2013 position, is by 31 March 2014.
It is important that the information submitted by your members to our member banks is up-to-date and accurate. This would ensure that both the trustees and beneficiaries enjoy full deposit insurance protection.
A trustee who fails to comply with this annual submission requirement commits an offence under section 195 of the Malaysia Deposit Insurance Corporation Act 2011 and may be liable to a fine, or to imprisonment, or both.

Invitation to Attend Yayasan Bantuan Guaman Kebangsaan Training in Malacca, Perlis and Kuala Lumpur
The Yayasan Bantuan Guaman Kebangsaan ("YBGK") was launched by the Prime Minister on 25 Feb 2011 and commenced operations on 2 Apr 2012.  YBGK is a comprehensive scheme that funds lawyers to do legal aid work in criminal matters.
We are pleased to inform Members that the next training will take place as follows: in Malacca on 29 Mar 2014, Perlis on 19 and 20 Apr 2014, and Kuala Lumpur on 26 and 27 Apr 2014.  We encourage lawyers who would like to do YBGK work to attend the training.
