Feedback on Operation of Construction Court 
We refer to Circular No 082/2013 dated 29 Mar 2013, entitled "Chief Registrar's Circular No 2 of 2013: The Establishment of the Construction Court".

The Subcommittee on Construction Law invites Members to provide feedback on the general operation and / or administration of the Construction Court, which commenced operation in Shah Alam and Kuala Lumpur on 1 Apr 2013.   

The Bar Council will raise Members' feedback and / or concerns with the relevant bodies, with a view to enhancing the operation and functioning of the Construction Court.
Members are requested to submit your input to Marianna Tan by email at ml.tan@malaysianbar.org.my by 30 Nov 2013 (Saturday).

Meetings Between Bar Council and the Judiciary
Bar Council have had several meetings with YAA Tun Dato' Seri Arifin b Zakaria, the Chief Justice of Malaysia ("CJ") and members of the Judiciary to discuss issues relating to court matters and the administration of justice.
The following are the issues that the Judiciary has requested us to bring to Members' attention, and to remind Members to comply with:
(1) Court of Appeal Practice Direction No 1 of 2009: Guidelines for Filing of Draft Orders / Judgments and Fair Orders in Court Proceedings and Civil Application in Court of Appeal
Members are requested to comply with the format of draft orders and time period for filing of draft orders in the Court of Appeal Practice Direction No 1 of 2009.
Attached please find a copy of the Court of Appeal Practice Direction No 1 of 2009.
(2) Court of Appeal Practice Direction No 4 of 2011: Guidelines for Filing of Draft Orders / Judgments and Fair Orders In Court Proceedings and Civil Application in Court of Appeal
Please be reminded of the Court of Appeal Practice Direction No 4 of 2011, with regard to the method of numbering record of appeal volumes.
Attached please find the Court of Appeal Practice Direction No 4 of 2011.
(3) Chief Registrar's Circular No 4/2010: Guidelines for Filing of Draft Orders / Judgments and Fair Orders / Judgments in Court Proceedings throughout Malaysia
Attached please find the Chief Registrar's Circular No 4/2010.
(4) Rubber stamping in place of signing in attendance in writing
Kindly note that you are encouraged to affix the rubber stamp of your name instead of writing your name in every copy of the Court Listing sheet for ease of recognition of names by court officials.
(5) Audio conferencing option at case management stage
Kindly be informed that audio conferencing is available at case management stage if all parties are in agreement to opt for audio conferencing.  The application form can be downloaded from the Judiciary's website.
(6) Cases printed from CLJ and MLJ online
Kindly be informed that the Court of Appeal and Federal Court accept the .pdf form of cases printed from CLJ and MLJ online.
(7) Practice Direction No 2 of 2013: Mediation Process for Road Accident Cases in Magistrates' Courts and Sessions Courts
With reference to Bar Council Circular No 036/2013 dated 13 Feb 2013, please be reminded of Practice Direction No 2 of 2013 relating to the mediation process for road traffic accident cases in the Magistrates' Courts and Sessions Courts.  Lawyers are reminded to cooperate and attend mediation hearings.
Attached please find Circular No 036/2013, in which a copy of the Practice Direction No 2 of 2013 can be found.
(8) Chief Judge of Malaya Practice Direction No 4/2013: Application for Notes of Evidence in Civil Cases 
With reference to Bar Council Circular No 170/2013 dated 14 Aug 2013, please be informed that pursuant to the Chief Judge of Malaya Practice Direction No 4/2013, the court will not provide a transcription of notes of evidence.  However, the court will provide a copy of the CD and the transcription has to be arranged by the lawyers themselves.
Attached please find Circular No 170/2013, in which a copy of the Chief Judge of Malaya Practice Direction No 4/2013 can be found.
(9) Court of Appeal  Practice Direction No 1/2008
Please be reminded of Court of Appeal Practice Direction No 1/2008, in particular to the direction on written submissions which provides that the written submissions shall be filed in four copies at the Registry of the Court of Appeal at least 14 days before the date of the hearing of appeal.
Attached please find the Court of Appeal Practice Direction No 1/2008.
Further, the Court of Appeal has created a special email address, appealwm@kehakiman.gov.my, to allow Members to send in written submissions and raise any queries with regard to Court of Appeal cases in West Malaysia.
Should you encounter any difficulties or issues pertaining to the email address, please contact the officers-in-charge, Noraisyah bt Mohd Yusof (03-8880 4156) or Safarudin b Tambi (03-8880 4048).
