Invitation to Attend Yayasan Bantuan Guaman Kebangsaan Training
in Penang, Pahang, Kuala Lumpur and Terengganu

The Yayasan Bantuan Guaman Kebangsaan ("YBGK") is a comprehensive scheme that funds lawyers to do legal aid work in criminal matters.  YBGK was launched by the Prime Minister on 25 Feb 2011 and commenced operations on 2 Apr 2012.  For information regarding the rates of payment to lawyers, please refer to Circular No 111/2014 dated 22 May 2014.
We encourage lawyers who would like to do YBGK work to attend the training.  The next training sessions will take place as follows:
(1) Penang: 20 and 21 Sept 2014;
(2) Pahang: 11 and 12 Oct 2014;
(3) Kuala Lumpur: 1 and 2 Nov 2014; and
(4) Terengganu: 22 and 23 Nov 2014.

Anti-Money Laundering and Anti-Terrorism Financing (Security Council Resolutions) (Al-Qaida and Taliban) (Amendment) Order 2014
Please take note that the Anti-Money Laundering and Anti-Terrorism Financing (Security Council Resolutions) (Al-Qaida and Taliban) (Amendment) Order 2014 ("Order") came into effect on 10 Sept 2014.
The Ministry of Home Affairs ("MoHA") has informed us that the amendments are to enable the procedure of freezing the assets of individuals / entities and groups listed by the United Nations Security Council to be made immediately (without delay).  The list in the Order refers directly to the Al-Qaida Sanctions List and 1988 List issued by the United Nations Security Council.
The relevant portion of MoHA's notification is reproduced below, and copies of the notification and the Order are attached.

PERINTAH PENCEGAHAN PENGUBAHAN WANG HARAM DAN PENCEGAHAN PEMBIAYAAN KEGANASAN (RESOLUSI MAJLIS KESELAMATAN) (AL-QAIDA DAN TALIBAN) (PINDAAN) 2014
Adalah saya dengan hormatnya merujuk kepada perkara di atas dan memaklumkan bahawa Perintah Pencegahan Pengubahan Wang Haram Dan Pencegahan Pembiayaan Keganasan (Resolusi Majlis Keselamatan) (Al-Qaida dan Taliban) (Pindaan) 2014 yang dibuat mengikut Seksyen 66C dan Seksyen 66D, Akta Pencegahan Pengubahan Wang Haram dan Pencegahan Pembiayaan Keganasan (AMLATFA) 2001 (Akta 613) telah diwartakan dan berkuat kuasa pada 10 September 2014.
2.  Untuk makluman YBhg. Tan Sri/Datuk/Dato' Sri/Dato'/Tuan/Puan, Perintah ini dipinda bagi membolehkan langkah-langkah pembekuan aset ke atas individu/entiti dan kumpulan yang disenaraikan oleh Majlis Keselamatan Pertubuhan Bangsa-Bangsa Bersatu (PBB) dibuat dengan serta-merta (tanpa kelengahan) di mana senarai di dalam Perintah ini merujuk secara terus kepada Al-Qaida Sanction List dan 1988 List yang dikeluarkan oleh pihak PBB.
3.  Bagi melaksanakan Perintah ini, semua Institusi Pelapor di bawah kawalan pihak YBhg. Tan Sri/Datuk/Dato' Sri/Dato'/Tuan/Puan dikehendaki menyemak dan membandingkan senarai nama individu dan kumpulan yang berada di dalam pangkalan data masing-masing dengan senarai-senarai yang dikeluarkan oleh PBB seperti berikut:
i) Senarai Jawatankuasa 1267 (Al-Qaida Sanction List):

4. Bagi melaksanakan Perintah ini dengan berkesan, Kementerian Dalam Negeri menyarankan Insitusi Pelapor menyemak kedua-dua senarai yang dinyatakan di atas dengan kerap dari semasa ke semasa.
5.  Perintah ini memperuntukkan hukuman denda sehingga satu juta ringgit atau penjara sehingga satu tahun atau kedua-duanya sekiranya wujud ketidakpatuhan terhadap Perintah ini.
