FAST TRACK FELLOWSHIP PROGRAMME
17 & 18 MAY 2014

Dear All,

The Malaysian Institute of Arbitrators (MIArb) will be organising a Fast-Track Fellowship programme on 17th and 18th May 2014.

The Fast-Track Fellowship programme will be conducted over two days and will comprise of a written exam covering three modules and an award writing exam. A Peer interview will be held later at a date to be fixed by the Council. Candidates must pass the exam on all three modules and the Award Writing examination to be entitled to attend the Peer Interview. The candidate must then successfully complete the Peer Interview.

The course modules are as follows:
1. Malaysian Arbitration Act and Jurisdiction of the Arbitrator;
2. Arbitration Procedure, Preliminary Meetings and Interlocutory Applications;
3. Arbitrators' Duties and Responsibilities, Ethics and Misconduct.

The Award Writing examination will be premised upon pleadings, brief witness statements, notes of evidence, written submissions and some brief documents arising from a mock dispute and arbitration scenario.

Candidates will be graded by their comprehension and appreciation of issues that arise from each course module and their ability to prepare a valid and enforceable award. Candidates will be allowed to hand-write or use their own notebooks to type up their answers to the exam and the award.

The course will be conducted over two days. The first day will comprise approximately 1 hour lecture on each of the course modules listed above followed by a written examination in the afternoon. The second day will comprise a two to three hour lecture on award writing followed by an Award Writing examination in the afternoon. The speakers for the various lectures will be distinguished and experienced arbitrators.

A list of reading materials will be provided to all candidates prior to the date of the commencement of the course and candidates are to make their own arrangements to source the said materials. There will also be a preliminary set of documents consisting of pleadings given to the candidates for the Award Writing exam so as to prepare the candidate for the same.

Both exams will be open book exams and candidates are allowed to have with them any books, articles or other documents which may assist them in the exams.

The registration fee will cover all course materials, lectures and examination costs. The Peer Interview will be conducted in conjunction with a dinner and will be priced according to the venue. Candidates that qualify for the Peer Interview will be informed in due time of the date, venue and price for the Peer Interview.

Registration is open to all persons who satisfy the following criteria:-

(a) Is a fit and proper person for admission as a Fellow and not one who had been convicted of any criminal offence by the courts of law;


(b) Be a person engaged in a profession, occupation or calling in which there is recourse to arbitration directly or indirectly;

(c) Be over 35 years of age at the date of the Fellowship Programme;

(d) Have obtained a degree or equivalent qualification from a university or tertiary educational body acceptable to the MIArb Council;

(e) Be a member of a professional, commercial, trade, industrial, or Government body acceptable to the MIArb Council e.g. architects, engineers, quantity surveyors, lawyers, accountants;

(f) Practised as an arbitrator and/or advocate in the arbitration or litigation of commercial disputes for not less than 10 years and be able to satisfy MIArb Council as to his/her proficiency in the law and practice relating to arbitration; and

(g) Ideally, shall have been a Member of the Institute for not less than five years.

Provided always that the MIArb Council may, in its discretion, waive totally or partly one or more of the requirements in (d), (e), (f) or (g) above.
