Invitation to Join Monitoring Team for "GST — Protest till it is Dropped" Rally (1 May 2014)
The Bar Council Human Rights Committee ("HRC") is organising a monitoring team to observe the "Goods and Services Tax ("GST") — Protest till it is Dropped" Rally organised by the May 1 Committee, scheduled to take place in Kuala Lumpur on 1 May 2014 (Thursday).  The monitoring team will look out for, and document, possible violations of human rights during the event.
Members of the Bar and pupils in chambers are invited to join the monitoring team.
Members of the monitoring team must adhere strictly to the rules and guidelines set by HRC in monitoring the rally.  The purpose of the team is strictly limited to monitoring the event, hence team members must not participate in the rally in any manner.
The names of the monitoring team members will be submitted to the organiser of the rally and the police, for the purpose of information, a day before the rally.

Please note that it is not compulsory for item (6) and item (7) to be paid together with items (1) to (5).  Payment of item (6) and item (7) can be made upon application for your 2015 Sijil Annual / Practising Certificate. 
We would like to draw your attention to sections 44, 46(5) and 46(6) of the Legal Profession Act 1976, which read as follows (emphases added):
Section 44 All members who are not in arrears with their subscription under section 46 shall be eligible—
(a) to attend and vote at any general meeting;
(b) subject to section 46A, to be elected to the Bar Council; and
(c) to vote on the election of members to the Bar Council.
Section 46(5) Liability to pay any annual subscription to the Malaysian Bar shall arise when the subscription has been fixed by the Bar Council. All annual subscriptions to the Malaysian Bar shall be paid by the 30th day of June of each year.
Section 46(6) An advocate and solicitor shall, if he pays his annual subscription after the date mentioned in subsection (5), pay to the Bar Council, in addition to the subscription due, an amount equivalent to the subscription so due.
Please note that the deadline of 30 June 2014 for payment of the annual subscription must be strictly adhered to and no application for waiver of penalty will be entertained.  If you fail to pay by the deadline of 30 June 2014, you will have to pay an additional sum of RM450.
Kindly ensure that your name and membership number are clearly written on the reverse side of each cheque.  The receipt for the sum of RM770 will be indicated as "Bar Council Subscription". 
The payment guide, which includes samples of how the cheques should be drawn for the relevant payments, is attached for your attention (refer to Appendix 1).
Also attached is a set of "Frequently-Asked-Questions on Bar Council Subscription" (refer to Appendix 2).
As part of Bar Council's initiative to improve and upgrade our services to Members of the Bar, the e-Statement feature was introduced on the Malaysian Bar website on 28 Sept 2011.  Registered users of the Malaysian Bar website can view, and download, the details of their own subscription payment records, and print receipts of payments made for the Bar Council subscription.  For more details, please refer to Circular No 297/2011 dated 19 Dec 2011.

Sila ambil perhatian bahawa pembayaran jumlah yang dinyatakan di perkara (6) dan perkara (7) tidak perlu dilunaskan bersama-sama jumlah yang dinyatakan di perkara (1) hingga (5).  Pembayaran yuran yang dinyatakan di perkara (6) dan perkara (7) boleh dilakukan ketika membuat permohonan untuk Sijil Tahunan / Sijil Amalan Tahun 2015. 
Sila ambil perhatian terhadap seksyen 44, 46(5) dan 46(6) Akta Profesion Undang-Undang 1976, yang mana seperti berikut (penekanan ditambah):
Seksyen 44 Semua ahli yang tidak terhutang yuran di bawah seksyen 46 layak—
(a) menghadiri dan mengundi dalam mana-mana mesyuarat agung;

Seksyen 46(6) Seseorang peguam bela dan peguam cara, jika dia membayar yuran tahunannya selepas tarikh yang disebut dalam subseksyen (5), hendaklah membayar kepada Majlis Peguam, sebagai tambahan kepada yuran yang terhutang, suatu amaun yang senilai dengan yuran yang terhutang sedemikian itu.
Sila ambil perhatian bahawa tarikh akhir pembayaran yuran tahunan adalah pada 30 Jun 2014.  Sebarang permohonan untuk pengenepian penalti tidak akan dilayan.  Sekiranya gagal untuk membuat pembayaran pada tarikh akhir iaitu pada 30 Jun 2014, amaun tambahan sebanyak RM450 akan dikenakan sebagai penalti.
Sila pastikan nama dan nombor keahlian ditulis dengan jelas pada bahagian belakang setiap cek.  Resit untuk jumlah sebanyak RM770 akan dicatat sebagai "Bar Council Subscription".

We refer to Circular No 090/2014 dated 17 Apr 2014, where Members were informed of a special briefing for lawyers on the new digital certificate for e-filing, which was held at the Kuala Lumpur Court Complex on 21 Apr 2014.

FAST TRACK FELLOWSHIP PROGRAMME
17 & 18 MAY 2014

Dear All,

The Malaysian Institute of Arbitrators (MIArb) will be organising a Fast-Track Fellowship programme on 17th and 18th May 2014.

The Fast-Track Fellowship programme will be conducted over two days and will comprise of a written exam covering three modules and an award writing exam. A Peer interview will be held later at a date to be fixed by the Council. Candidates must pass the exam on all three modules and the Award Writing examination to be entitled to attend the Peer Interview. The candidate must then successfully complete the Peer Interview.

The course modules are as follows:
1. Malaysian Arbitration Act and Jurisdiction of the Arbitrator;
2. Arbitration Procedure, Preliminary Meetings and Interlocutory Applications;
3. Arbitrators' Duties and Responsibilities, Ethics and Misconduct.

The Award Writing examination will be premised upon pleadings, brief witness statements, notes of evidence, written submissions and some brief documents arising from a mock dispute and arbitration scenario.

Candidates will be graded by their comprehension and appreciation of issues that arise from each course module and their ability to prepare a valid and enforceable award. Candidates will be allowed to hand-write or use their own notebooks to type up their answers to the exam and the award.

The course will be conducted over two days. The first day will comprise approximately 1 hour lecture on each of the course modules listed above followed by a written examination in the afternoon. The second day will comprise a two to three hour lecture on award writing followed by an Award Writing examination in the afternoon. The speakers for the various lectures will be distinguished and experienced arbitrators.

A list of reading materials will be provided to all candidates prior to the date of the commencement of the course and candidates are to make their own arrangements to source the said materials. There will also be a preliminary set of documents consisting of pleadings given to the candidates for the Award Writing exam so as to prepare the candidate for the same.

Both exams will be open book exams and candidates are allowed to have with them any books, articles or other documents which may assist them in the exams.

The registration fee will cover all course materials, lectures and examination costs. The Peer Interview will be conducted in conjunction with a dinner and will be priced according to the venue. Candidates that qualify for the Peer Interview will be informed in due time of the date, venue and price for the Peer Interview.

Registration is open to all persons who satisfy the following criteria:-

(a) Is a fit and proper person for admission as a Fellow and not one who had been convicted of any criminal offence by the courts of law;


(b) Be a person engaged in a profession, occupation or calling in which there is recourse to arbitration directly or indirectly;

(c) Be over 35 years of age at the date of the Fellowship Programme;

(d) Have obtained a degree or equivalent qualification from a university or tertiary educational body acceptable to the MIArb Council;

(e) Be a member of a professional, commercial, trade, industrial, or Government body acceptable to the MIArb Council e.g. architects, engineers, quantity surveyors, lawyers, accountants;

(f) Practised as an arbitrator and/or advocate in the arbitration or litigation of commercial disputes for not less than 10 years and be able to satisfy MIArb Council as to his/her proficiency in the law and practice relating to arbitration; and

(g) Ideally, shall have been a Member of the Institute for not less than five years.

Provided always that the MIArb Council may, in its discretion, waive totally or partly one or more of the requirements in (d), (e), (f) or (g) above.

Update on Malaysia/Singapore Bench and Bar Games and
Quadrangular Bar Games 2014, Kuala Lumpur (1 to 3 May 2014)
The Kuala Lumpur Bar Committee will play host to the 45th Malaysia/Singapore Bench and Bar Games and 5th Quadrangular Bar Games ("Games"), to be held in Kuala Lumpur from 1 to 3 May 2014 (Thursday to Saturday).

Subsidy for Participants from Outstation
Kindly note that accommodation subsidy will be given by Bar Council to participants from outstation, on a twin-sharing basis.  This subsidy is only applicable to participants who stay at Pullman Kuala Lumpur Bangsar Hotel. 
Participants are required to settle their room charges upon checking out and provide Shegi Nair with their bills and receipts for the purpose of obtaining the subsidy.

We call upon our Members, particularly those in the Klang Valley, to show up and support the Malaysian Bar sports teams as they take on their counterparts from the Law Society of Singapore, Advocates' Association of Sarawak and Sabah Law Association.
