About the Book
Where there is an order for a stay of execution of an order of court, the effect is that the
order appealed from is not carried into effect or its execution is suspended with or
without any terms or conditions attached to the order staying execution of that earlier
order, while the appeal is being determined. The order which has been stayed shall not
be operative with effect from the time of the making of the order of stay. The order of
court is in effect 'in abeyance'; it has not been set aside, only that the said order shall
not be operative from the time of the making of the order of stay.
This book examines the law and procedure and the authorities relating to the subject of
stay of execution. Provisions on stay of execution of orders or proceedings may be found
in the Rules of Court 2012 and the Courts of Judicature Act 1964. These are examined
extensively throughout the publication.

Tambahan dan Pindaan Kepada Arahan Amalan Bil 6 Tahun 2013 Mengenai Pengkelasan Kod Bagi Kes-Kes di Mahkamah Tinggi, Mahkamah Sesyen dan Mahkamah Majistret Seluruh Malaysia
We refer to Circular No 139/2013 dated 19 June 2013.
The Chief Registrar of the Federal Court of Malaysia, Azimah bt Omar, has extended to us a copy of Arahan Amalan Bil 7 Tahun 2013 relating to addition and amendments to Arahan Amalan Bil 6 Tahun 2013.
Please be informed that Arahan Amalan Bil 7 Tahun 2013 takes effect retrospectively from 1 July 2013 (Monday).
A copy of Arahan Amalan Bil 7 Tahun 2013 is attached for your reference.

TEMPOH MENYEDIAKAN PENGHUJAHAN BAGI KES JENAYAH
Setelah berunding dengan YAA Ketua Hakim Negara, adalah diarahkan semua Yang Arif Hakim / Pesuruhjaya Kehakiman Mahkamah Tinggi Malaya, Hakim Mahkamah Sesyen, Majistret Kanan / Majistret, Timbalan Pendaftar / Penolong Kanan Pendaftar, Pendaftar Kanan dan Pendaftar Mahkamah Rendah seluruh Semenanjung Malaysia untuk memberikan tempoh tidak melebihi tujuh (7) hari bagi membolehkan pihak pendakwaan dan pihak pembelaan untuk menyediakan penghujahan setelah kes pendakwaan atau pembelaan selesai.
2.          Walau bagaimanapun, tempoh ini boleh dilanjutkan ke satu (1) tempoh yang munasabah jika ia melibatkan kes-kes yang kompleks.
3.         Ini adalah bertujuan memberi keadilan kepada semua pihak untuk menyediakan penghujahan dalam masa yang mencukupi. Ianya juga bertujuan untuk mengelakkan permohonan penangguhan tidak wajar dari mana-mana pihak setelah mereka menghabiskan kes.
4.         Arahan ini berkuatkuasa 15 Ogos 2013.
