New Criteria for Empanelment of Mediators on the Panel of the Bar
Council Malaysian Mediation Centre (MMC)

In anticipation of the proposed Mediation Act and/or the Court Annexed Mediation coming into force, the Bar Council has decided to open up the panel of Mediators of the Bar Council MMC to mediators who are not advocates and solicitors. In light of this decision, the Arbitration and Alternative Dispute Resolution Committee has revised its criteria and proposed a new scheme for the Accreditation of Mediators to cater for this change which the Bar Council has adopted.

The main objective of introducing the scheme is to ensure some control over the quality of mediators coming on board the MMC's panel. The following are amongst the criteria imposed on mediators who wish to be empanelled on the panel:

(a) Individuals who have successfully completed a 40-hour mediation workshop conducted by other organisations would have to be interviewed by a panel of 3-mediators duly appointed by the Chairperson of the MMC for purposes of assessing their skills and knowledge about mediation; and

(b) Such individuals should demonstrate a high level of understanding, expertise and skills required of a mediator in a mediation process.

Mediators duly appointed or to be appointed are required to settle an annual subscription fee (preferably by 31 Jan of any calendar year) as follows:

Mediators (Practising advocates and solicitors) RM100
Mediators (Non-Members of the Bar/Non-practising advocates and solicitors) RM200

ILKAP TRAINING PROGRAMMES FOR THE PRIVATE SECTOR


The Judicial and Legal Training Institute/Institut Latihan Kehakiman dan Perundangan  (ILKAP) was established with its primary objective to enhance the skills and knowledge of officers in the judicial and legal services, statutory bodies and local authorities through training and by providing continuing education.
