Press Release

Heartfelt condolences to the families of the murder victims
 
The Malaysian Bar expresses its deepest condolences to the families of Datuk Sosilawati Lawiya and the other victims of the recent murders, and conveys its sympathies and support particularly to the family of Ahmad Kamil Abdul Karim, a Member of the Bar.
 
We condemn the perpetrators of these heinous crimes, and urge the police to continue their efforts to investigate the incidents exhaustively, and to ensure that those responsible are charged in court as soon as possible. Nothing should be allowed to detract from the primary focus of the matter, which must be that justice is served expeditiously through the criminal justice system. The police investigation has been thorough thus far, and we are pleased to note that the police have indicated that they are close to solving the case. 
 
We urge the media and the public to ensure that the rights of all parties, including the persons who have been detained, are protected. We are concerned that undue allegations or speculation could prejudice or jeopardise the investigation and the outcome of any court proceeding. The remanded persons are innocent until proven guilty, and must be given a fair chance of defending themselves.  
 
We reiterate that the Malaysian Bar does not condone any form of misconduct by any of its Members. We welcome, and support, strict action by the police against errant lawyers. We have always assisted the police when police reports are lodged against Members of the Bar in relation to their legal practice, and will continue to do so.   
 
We wish to provide clarification with respect to the powers of the Bar Council, which is a statutory body established to regulate the practice of the legal profession in Peninsular Malaysia. The Bar Council's powers are limited, like those of any other professional body, to supervise and regulate the professional conduct of the Members of the Malaysian Bar.  
 
The Bar Council does not have the authority to inquire into the private conduct of individuals who are lawyers by profession, including matters relating to their private lives, such as their bank accounts and other assets. Other enforcement agencies, such as the police, Malaysian Anti-Corruption Commission, Bank Negara Malaysia or Inland Revenue Board, have the mandate to conduct such investigations. Any criminal conduct that falls outside the scope of a lawyer's professional practice is also beyond the Bar Council's jurisdiction.  
 
The Advocates and Solicitors Disciplinary Board is one of the most stringent professional bodies in Malaysia, to the extent that Members of the Bar have complained that it is biased against them. The Disciplinary Board undertakes a rigorous inquiry into each instance of alleged misconduct by lawyers. On average, 30 lawyers were struck off during each of the past five years. Although this represents a mere 0.2% of our total membership, it is indicative of the Malaysian Bar's commitment to act in the public interest, and our intolerance of any wrongdoing by our Members.

We have finalised the Programme for the upcoming 2 day conference.

As you know, the theme for the AA Conference this year will be: JUSTICE-CONNECT TO GOD'S CALL. The Conference will involve discussions, workshops and action plans in relation to religious liberty, justice as explained in the scriptures and how we relate all this back to God.

In case you missed our last update, we would like to reiterate that in the interest of ensuring that as many participants as possible are able to attend, a reduction in Conference Fees was proposed and agreed unanimously. In the same vein, the OC also increased the subsidised Student/Pupil to 50 pax (earlier it was confined to 40 pax).

Kelab Belia Graduan 1Malaysia's Police Report Baseless
 
The Malaysian Bar understands that a police report has been lodged against its MyConstitution Campaign by Kelab Belia Graduan 1Malaysia (KBGM). KBGM has reportedly voiced concern that the booklets produced under the Campaign (Rakyat Guides) may be seditious.
 
We believe that KBGM's concerns about the Campaign are misplaced, and stem from a lack of knowledge and understanding of the Campaign as well as the Federal Constitution (Constitution).
 
The Campaign's aim is to increase awareness of the Constitution among Malaysians because the Constitution defines our country. It is not the Malaysian Bar's aim to seek to amend the Constitution. The Campaign is non-partisan and we make every effort to work with all individuals and entities who wish to work with us. To date, our activities have been graced and supported by a Minister and a Deputy Minister in the Prime Minister's Department, a Chief Minister, two Menteri Besar, Members of Parliament including the Speaker and Deputy Speaker of the Dewan Rakyat, and many other bodies.
 
KBGM's main concern seems to be that the Rakyat Guides have informed the Malaysian public that the Constitution says it can be amended by Members of Parliament who are elected by Malaysians. The Constitution does in fact say this. To our knowledge, Parliament has amended the Constitution more than 40 times over the past 53 years with approximately 650 individual amendments. 
 
In general, constitutional amendments require support from two-thirds of Members of Parliament. However, some provisions in the Constitution, like that relating to the special position of the Malays, can only be amended with the consent of the Council of Rulers.
 
KBGM's allegation that the Campaign is funded by a foreign NGO that is anti-government is baseless. The MyConstitution Campaign is non-profit. It is funded by the Malaysian Bar and has received contributions from many other bodies, including the Federal Government, State Governments, political and non-political organizations, and the Malaysian public.
 
The MyConstitution Campaign seeks to inform Malaysians on what the Constitution actually says. It encourages people to read the Constitution themselves, and learn what is and is not in the Constitution. In this regard, we believe that KBGM's concerns can be alleviated by knowledge of the Constitution. We invite KBGM to a discussion and are willing to work with it so that we may together 'Merakyatkan Perlembagaan'.
 
A press conference in relation to this statement will be held tomorrow (7 September 2010) at 12:30pm at the Conference Room 1, 3rd floor, Bar Council, No. 15, Leboh Pasar Besar, 50500 Kuala Lumpur. An invitation to the press conference will follow.

LAPORAN POLIS KELAB BELIA GRADUAN 1MALAYSIA TIDAK BERASAS
 
Badan Peguam difahamkan bahawa satu laporan polis telah dibuat terhadap Kempen Perlembagaanku oleh Kelab Belia Graduan 1Malaysia (KBGM). Adalah dilaporkan bahawa KBGM telah menyuarakan kebimbangannya bahawa buku-buku panduan yang dikeluarkan oleh Kempen itu (Buku Panduan Rakyat) mungkin bersifat menghasut.
 
Kami percaya bahawa kebimbangan KBGM tentang Kempen itu adalah tersasar, dan timbul akibat kurangnya pemahaman dan ilmu berkenaan Kempen itu dan juga Perlembagaan Persekutuan (Perlembagaan).
 
Tujuan Kempen ini adalah untuk meningkatkan kesedaran tentang Perlembagaan di kalangan rakyat Malaysia kerana ia memberi makna kepada negara kita. Ia langsung tidak menjadi matlamat Badan Peguam untuk cuba membuat pindaan terhadap Perlembagaan. Kempen ini tidak bersifat kepartian dan kami mengambil segala usaha untuk menjalinkan usahasama dengan semua pihak yang mahu bekerjasama dengan kami. Setakat ini, aktiviti-aktiviti kami telah dihadiri dan disokong oleh seorang Menteri dan seorang Timbalan Menteri di Jabatan Perdana Menteri, seorang Ketua Menteri, dua Menteri Besar, Ahli-ahli Parlimen termasuklah Yang di-Pertua Dewan Rakyat dan Timbalan Yang di-Pertua Dewan Rakyat dan pihak-pihak lain.
 
Nampaknya kebimbangan utama KBGM adalah bahawa Buku Panduan Rakyat telah memaklumkan rakyat Malaysia yang Perlembagaan menyatakan bahawa ia boleh dipinda oleh ahli-ahli Parlimen yang dipilih oleh rakyat Malaysia. Ini sememangnya ada dinyatakan di dalam Perlembagaan. Dalam pengetahuan kami, Parlimen telah meminda Perlembagaan lebih daripada 40 kali dalam masa 53 tahun yang lalu dengan lebih kurang 650 pindaan individu. 
 
Secara amnya, pindaan perlembagaan memerlukan sokongan dua pertiga ahli-ahli Parlimen. Namun demikian, terdapat beberapa peruntukan di dalam Perlembagaan seperti yang berkaitan dengan kedudukan istimewa orang Melayu, yang hanya dapat dipinda dengan kebenaran Majlis Raja-raja.
 
Dakwaan KBGM bahawa Kempen ini dibiayai oleh NGO asing anti-kerajaan adalah tidak berasas sama sekali. Kempen PerlembagaanKu adalah kempen yang tidak mengaut keuntangan. Ia dibiayai oleh Badan Peguam Malaysia dan telah menerima sumbangan daripada pelbagai pihak, termasuklah Kerajaan Persekutuan, Kerajaan-kerajaan Negeri, badan politik dan bukan politik serta rakyat Malaysia.
 
Kempen PerlembagaanKu bertujuan untuk memaklumkan rakyat Malaysia tentang apa yang dinyatakan di dalam Perlembagaan. Ia mengalakkan orang ramai untuk membaca Perlembagaan dengan sendiri dan mempelajari tentang apa yang terkandung dan tidak terkandung di dalam Perlembagaan. Dalam hal ini, kami percaya bahawa kebimbangan KBGM dapat diatasi dengan ilmu pengetahuan berkenaan dengan Perlembagaan. Kami menjemput KBGM untuk mengadakan perbincangan dan sedia bekerjasama dengannya untuk bersama-sama 'Merakyatkan Perlembagaan'.
 
Sebuah sidang media berkaitan dengan kenyataan media ini akan diadakan esok (7 September 2010) pada pukul 12.30 tengahari di Conference Room 1, Tingkat 3, Bar Council, No. 15, Leboh Pasar Besar, 50500 Kuala Lumpur. Jemputan ke sidang ini akan dihantar seterusnya.

2nd Asia Pacific Regional Forum Conference:
Asia after the Global Financial Crisis - Leading the Global Recovery
 
The Asia Pacific Regional Forum of the International Bar Association (IBA) is organising its 2nd Asia Pacific Regional Forum Conference in Tokyo.  Details of the Conference are as follows:
Date:   17 – 19 Nov 2010
Venue:  Tokyo International Forum, Japan

This Conference brings together experts from throughout the Asia Pacific region and beyond to discuss current opportunities, issues, risks and practical considerations for investors and others doing business in the emerging and developed markets of the Asia Pacific region in the aftermath of the global financial crisis.

Alternatively, please fill out the registration form contained within the attached programme brochure, and return it along with payment to the IBA office.  To receive the early registration discount, Members must register by 8 Oct 2010 (Friday).

Scholarship to attend the Conference
The Asia Pacific Regional Forum will be awarding two scholarships to two young lawyers who wish to participate in the Conference but may find financial difficulties in doing so.
 
The Scholarship Award includes:
- Free registration for the Conference, 17-19 Nov 2010, Tokyo, Japan;
- A contribution towards travel and accommodation costs to the Conference;
- A ticket to the evening dinner on 18 Nov 2010 (Thursday).

Applications must be submitted by 17 Sept 2010 (Friday).  For further information, please refer to the attached Scholarship Application Form.
